Auctioneers Terms and Conditions

By making a bid, Bidder accepts the terms and conditions below and will be bound by them.

Everything will be sold “as is, where is”, with no guarantee of any kind, regardless of statement of condition made from the auction block.  What you see is what you get.  All items will sell absolute with no reserve prices.  No guarantees or warranties.  WYATT AND SON AUCTIONS, LLC (hereinto referred to as “W&S”) does not represent any of the manufacturers therefore you are purchasing the items as recovered freight.

W&S makes no warranty, expressed or implied. It is the Bidder’s responsibility to determine condition, age, genuineness, value or any other determinative factor of items for sale.  Buyers shall rely entirely on their own inspection and information.  No collusion is allowed.

EVERYTHING MUST BE PAID IN FULL ON THE DAY OF THE AUCTION.  Payment is due immediately after the close of the auction.  ALL SALES ARE FINAL.  The record of sales kept by the auctioneer and clerk will be taken as final.

If an item purchased is deemed to be proprietary, the customer is required to return the item for a full refund of the auction hammer price.  Proprietary items including but not limited to any and all weapons, illegal drugs, IDs, privacy related items, alcohol, tobacco, aviation parts, firearms, military and government-related items or equipment, prototypes, and industrial electronics, original artwork or any items that should not be on the open market, etc.

Buyer is prohibited from selling or returning any items to the original manufacturer.  W&S may ask the buyer to return Goods to W&S upon W&S’s request. In the case that W&S requests recovery of any Goods, Buyer shall return the Goods to the auction house and we will reimburse the Buyer up to the Purchase Price.  

 

The bidder is responsible for knowing which item he/she is bidding on.  If he/she is unsure, the bidder should inquire or not bid.  When you become the winning bidder at auction you have effected a contract and will be expected to pay for items in which you were evidenced to be the successful bidder.

Announcements made the day of the sale take precedence over written or advertised announcements, but do not alter, in any way, the terms and conditions of the sale.

Photos/Catalog
Auction Catalog and photos are meant as a guide only.  We do not guarantee the counts or the accuracy of the photos. The lot descriptions are meant merely as a guide, and we do not guarantee the counts or descriptions described therein.  W&S reserves the right to group lots, reduce or add quantity to lots, add lots, or delete lots.  W&S makes every effort to accurately describe all items, but there is the possibility of error. W&S is not responsible for any errors or omissions in the description of merchandise.

Fees 
A 15% Buyer’s Premium will be applied to all purchases, unless otherwise stated on the auction posting.  Sales tax will be charged to all purchases unless the buyer has proof of a sales tax exemption.

Bidding/Registration
All those wishing to participate at the auction are required to register through our website.  By registering, you agree to receive emails from W&S with upcoming auction news and other information.  You can unsubscribe at anytime.

Forms of payment
Cash and ETF’s are accepted with no fee.  Credit cards will incur a 3% fee on the total price of the invoice. After all lots have closed and auction has ended, invoices will then be emailed with a link provided for payment.  W&S will collect payment either in person at the auction warehouse or through payment portals. If the Payment Due is not received by 12pm EST on the following day after the conclusion of the auction, the bidder unconditionally authorizes W&S to charge any credit card on file for the amount due.

Auction Process
The auction is open to the public and is an online timed auction format.  The first lot closes Thursday at 8am and every 15 seconds after the next closes.  If there is a bid in the final few minutes of closing the bid clock will reset 5 minutes per bid.  There are no in person previews. The auctioneer reserves the right to accept bids in any increment he feels is in the best interest of his client, the seller.  The Auctioneer reserves the right to reject the bidding of any person whose conduct, actions, or adverse comments he feels are not in the best interest of the seller.  We reserve the right to refuse service to anyone.  Only those who have purchased items are allowed into the auction house.  NO CHILDREN PLEASE.

Removal
Buyers are responsible for removal of their items by the date and specified time (or times) of each auction.   After an item has been sold, it becomes the sole responsibility of the purchaser.  Bidders must have their paid invoice in hand to show proof of purchase.  Pallet jacks will be provided to assist in removal of the items.  Forklifts are available as needed.  Pallets, gaylord boxes, and wire bins are property of the auction house.  Wire bins are not to be removed from the auction house.  If removed and not returned within 7 days there will be a $250 rental charge per wire bin.  W&S will have staff in place to ensure the correct items are being removed from the auction house.  Every effort is made to “guard” the lots/product throughout the auction; however, the bidder becomes solely responsible for all items purchased by him/her immediately following his/her winning bid. Therefore, he/she is advised to further guard his items at his own discretion.  Purchases will not be released until the invoice is paid in full.

Disclaimer
While every effort has been made to dispose of brand-name counterfeits there is no claim to the authenticity or value of any item. If the successful buyer has reason to believe the item is counterfeit, he or she must notify someone at the facility prior to leaving the premises. The item in question will be immediately destroyed with no further investigation into the authenticity, and no adjustment will be made to the amount paid for the lot.

FAQ’s

What payment terms do you accept?

We accept credit cards (3% fee), EFT and cash.

Do you do shipping?

We currently don’t offer shipping. If you require shipping, contact us for a list of shipping companies.

How does pick up work?

You can come to our warehouse and pick up the items on auction day and the morning after the auction. We have pallet jacks, a loading dock, and forklifts. Our guys can help you with the forklift.

What does as is/where is mean?

That means you are purchasing items with no warranty express or implied and what you see is what you get, and returns are not accepted. Once you pay the invoice for the item(s), we will not take it back.

How do the online auctions work?

The online auctions are similar to eBay. If you put in a bid it will be considered your max bid. You can also put in a max bid and our software will automatically bid you up to the next increment until your max is reached.

How do I know if I’ve won my lots?

You can click on your bidder profile and see the items you’ve both won and lost. We also send out e-mails after the auction announcing the winners.

What time do you close?

We close at 4:00p (EST) on auction day. You can pick up Friday until noon.

Can I contact you with questions about a certain lot?

Absolutely you can. Just make sure it isn’t the night before the auction or the morning of.
